Judge Rules That StockX is Liable For Selling Counterfeit Nike Sneakers

In an update to the years-long Nike vs. StockX legal case, which began in 2022 when StockX began selling NFTs on its platform, Nike has won a partial summary judgment. The judge has ruled that StockX is liable for selling counterfeit Nike sneakers on its platform, though it did rule against Nike’s false advertising claim from the motion.
In November 2024, Nike sought a pre-trial win on counterfeiting and false advertising claims. Nike discovered that StockX sold fakes on its platform through its own investigation and through a buyer named Roy Kim, who purchased 37 different sneakers that turned out to be fake. While this breaking news that the judge in the case has ruled that StockX is liable for selling these fake products on its platform, this represents just a small win within a larger battle.

The two parties will still go to trial over six other claims made against StockX by Nike in The Swoosh’s initial complaint, including Trademark Infringement, False Designation of Origin / Unfair Competition, Trademark Dilution, Injury to Business Reputation and Dilution, Common Law Trademark Infringement and Unfair Competition, and False Advertising. The trial will take place between June 15, 2025, and November 15, 2025, but not during the last week of August or the first four weeks of September.
